New laws for young workers The Child Employment Act 2006 was introduced on 1 July, 2006. It aims to protect all children working in Queensland, ensuring that work does not interfere with their education and that the work they perform does not harm their health and safety or physical, mental, moral and social welfare. Easter, Anzac Day and Labour Day Trading Hours 2006 Special trading hours arrangements apply for retail shops over the Easter, Anzac Day and Labour Day periods. Over the Easter period (Wednesday, 12 April 2006 to Wednesday, 19 April 2006) non-exempt shops are to remain closed on Friday, 14 April 2006 and only certain areas are allowed to trade on Sunday, 16 April 2006 and Monday, 17 April 2006. Independent retail shops are required to be closed until 1:00pm on Friday, 14 April 2006 (unless they are predominantly food and/or grocery stores). On Anzac Day Tuesday, 25 April 2006 non-exempt shops are to remain closed whilst Independent retail shops are required to remain closed until 1:00pm (unless they are predominantly food and/or grocery stores). Non-exempt shops are to remain closed on Labour Day Monday, 1 May 2006, excluding hardware shops in some areas of the State. Independent Retail shops have unrestricted trading hours on this day.

NEW AWARD - Outdoor Leaders Award - State 2005 (Effective 16/01/2006) This Award applies to all employees who are employed in or in connection with: the conduct of outdoor activities (or 'simulated' outdoor activities in indoor environments); instructing participants in the skills necessary to undertake such activities; and to employees of contractors and sub-contractors engaged substantially to undertake work at or for establishments providing these activities. However, this Award will not apply to employees who have the autonomous right to hire and or terminate other employees. Refer to clause 1.3.5 for a definition of "outdoor activities". This Award takes effect from 16 January 2006, except for Youth Enterprise Trust where the operative date will be 27 February 2006

REPEAL & NEW AWARD: Health & Fitness Centres, Swim Schools & Indoor Sports Award - State 2005 - Effective 01/03/05 (QGIG 22/04/05) The "HEALTH AND FITNESS CENTRES, SWIM SCHOOLS AND INDOOR SPORTS AWARD - STATE 2005" repeals and replaces the "Health and Fitness Centres, and Indoor Sports Award - South East Queensland 2003", effective from 1 March 2005. This Award shall apply to all employees (who are classified within the award) of health and fitness centres, swim schools and aqua facilities, whether the facilities are leased from municipal baths or not, indoor sports centres or similar facilities, and to their employers, throughout Queensland.

FEDERAL: AIRC awards $19 Living Wage increase to federal award workers On 5 May 2004, the full bench of the Australian Industrial Relations Commission (AIRC) granted all workers covered by federal awards an extra $19 per week, raising the Federal Minimum Wage from $448.40 to $467.40 per week, a 4.2% increase.

Queensland Minimum Wage effective 1st April 2003 Queensland's Industrial Relations Act 1999 now provides for a minimum rate of pay for all employees whether or not they are covered by an award or agreement. All employees (subject to certain exclusions below) now have a legally enforceable entitlement to a minimum rate of pay no matter what sort of work they do.

Queensland Minimum Wage (QMW) for all employees On the 18th December, 2002 the full bench of the Queensland Industrial Relations Commission (QIRC) issued a declaration of general ruling setting a Queensland minimum wage of $431.40 for all full-time employees in Queensland, including award free employees. The general ruling comes into effect at the beginning of the first pay period commencing after 1st April 2003. The full bench decision deals separately with award employees and award free employees.

New Award for Tour Guides commences on 1st January 2003 A new award entitled Tour Guides Award - State 2003 will take effect on 1st January, 2003 and will cover those employers who employ Tour Guides to conduct, supervise or assist in a tour and/or supplies guide services to travel agents, other tour companies, inbound tour operators, tour product operators, educational product operators, resorts, hotels and/or other similar organisations. Sunday Trading for South-East Qld from 1st August 2002 The trading (Allowable Hours) Amendment Act 2002 was passed in the Queensland Parliament on 6 March 2002. The Act created a single trading hours zone for the South-East Queensland area with uniform trading for all non-exempt, or large shops from 9am to 6pm on Sundays and certain public holidays. This area extends north to Noosa, south to Coolangatta and west to Amberley The new trading arrangements operate as from 1st August, 2002. Loading Increases for Casual Workers On 6 April 2001, a full bench of the Queensland Industrial Relations Commission declared, by way of a general ruling that loadings for casual employees provided by awards were to be increased in three stages. This is a reminder that from 2 April 2002, the minimum rate of casual loading will be 23% in accordance with stage 3 of the full bench decision.
